Terms and Conditions

GENERAL

1. Commissions are STRICTLY for PERSONAL USE ONLY.
2. You may upload my work to social media and use it as your display photos, provided I am properly credited.
3. Using the illustration/s in any AI-related technology, including AI Art Generators, is STRICTLY prohibited.
4. All commission-related communication should be conducted in writing via email or direct message (via VGen, Instagram, or TikTok). Written communication helps ensure every detail is accounted for.
5. Fixed Art Style means, don't ask me to mimic another artist's style/s.
6. I reserve the right to decline commissions outside my abilities or for subjects that I will not draw.
7. I will not be held liable for any misunderstandings or misconceptions if the commissioner fails to thoroughly read my Terms of Service.
8. Finished artwork/s will be sent via Dropbox, which contains both JPEG and/or PNG files (both watermarked and non-watermarked).

OTHER NOTES

1. To avail your commissions, you can either:

b. Order via Vgen (for International customers)}
2. Rates listed are base prices only and may vary based on complexity, duration, scope, and operational expenses (e.g., Electricity, internet, etc.).
3. Prices are open for negotiations.
Commissions are on a first-come, first-served basis. (Not applicable for Priority customers)
4. You receive 3 revisions (sketch stage only). Additional revision costs Php500/USD9 each. Please provide all feedback at the sketching stage.

PAYMENT

1. Payment modes through Maya, GCash or Bank Transfers (via GoTyme Bank or CIMB Bank) (for Philippine customers only), Paypal and VGen Payments (for International customers).
2. All payments will be made upfront in full or 50% downpayment through an agreed platform. Strictly NO DOWNPAYMENT, NO WORK.
3. After the project completion, please settle the remaining 50% before sending the files (for 50% downpayment only).

REVISIONS

1. Revisions are only available during the sketch phase.
2. Once sketches are approved, no further changes will be made unless due to an error on my part. Mistakes I made will always be corrected at no cost.

DEADLINES & DELIVERY

1. Commissions may take up to 7-14 days (excluding Philippine holidays) depending on how many character/s.
2. Please refrain from rushing me, as it adds pressure and affects quality. I also balance personal commitments offline.
3. I will make sure to keep you updated if delays occur (complexities, emergencies and/or personal matters).
4. If you wish to skip the Queue and be Priority, the 20% rush fee will be added. You will have to state it in the forms that you wish for it.

INTELLECTUAL PROPERTY RIGHTS

I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.I may use the artwork to:
-Promote myself and my services.
-Post on social media and in my portfolio.Exceptions:
If you're requesting that the artwork will be made in private, it will not be posted or used for promotional purposes.

REFUNDS

-I may cancel an art commission at any time.
-You may cancel before payment is made.
-Once payment is received, refunds are not available.Filing a chargeback will:
-Forfeit your rights to use artwork.
-Place you on a blacklist (with evidence).
-Allow me to reuse the artwork as I see fit.
-Result in a formal complaint against you.

COMMISSIONER RIGHTS

You may:
-Use the artwork for personal purposes only.
-Print the artwork for yourself
-Post it on social media as long as you give credits to the artist by tagging me “@pixelmallowsart”You may NOT:
-Use the artwork commercially without permission.
-Commission art/services using my Design/Work.
-Claiming the artwork as your own or failing to give credit to the artist.
-Remove watermarks.
-Resell or redistribute the artwork.
-Modify the artwork without consent.
-Use artwork purchased for Personal Use in merch, streaming, or commercial purposes.

BLACKLIST POLICY

-Breaking these rules may result in a permanent blacklist (with evidence).
-The blacklist may be shared with other artists.

FINAL AGREEMENT

By commissioning me, you acknowledge that you have read, understood, and agreed to all the terms above.
